Article 1. Purpose
These Terms set out the rights, duties, and responsibilities between Kimiyoka (“Operator”) and members in connection with the use of the Peekrate service (the “Service”).
Article 2. Definitions
- “Member” means a person who agrees to these Terms and uses the Service.
- “Content” means any image, text, or chat record that a Member uploads to or generates within the Service.
- “Result” means the score, label, explanation, OG card, and other outputs that the Service generates from an uploaded image.
Article 3. Effect and Changes
These Terms take effect when posted in the Service. The Operator may amend these Terms within applicable law and will provide at least 7 days’ notice (or 30 days for changes that materially disadvantage Members). Members who do not accept an amendment may cancel their membership.
Article 4. Membership
- Membership is established when a person agrees to these Terms and the Privacy Policy and the Operator accepts the application.
- Children under 14 may not register.
- Members must provide accurate information and update it without delay if it changes.
- Members are responsible for safeguarding their account credentials and must not transfer or lend them.
Article 5. The Service
- The Service is an entertainment product that produces AI-generated results from uploaded images.
- Results are for amusement only and may not be relied on as medical, psychological, legal, employment, or any other professional judgment.
- The Operator may change or discontinue any part of the Service.
Article 6. Member Obligations and Prohibited Conduct
Members shall not:
- Upload images of other people without the consent of the rightful person.
- Upload inappropriate content depicting minors.
- Upload obscene, violent, hateful, or illegal content.
- Upload content that infringes another party’s copyright or other rights.
- Interfere with the operation of the Service or bypass abuse-protection mechanisms (Turnstile, rate limits, WAF, etc.).
- Scrape or redistribute the Service or Results using automated tools.
Article 7. Content Ownership and License
- You retain ownership of any image you upload.
- You grant the Operator a non-exclusive, royalty-free license to process the image to the extent necessary to deliver and operate the Service. The license is limited to analysis; original images are deleted after analysis completes.
- Shared OG cards are generated only from score, keywords, and teaser text and never embed the original image.
Article 8. Intellectual Property
The Service itself, its design, code, prompts, and the visual presentation of generated Results belong to the Operator or its licensors.
Article 9. Paid Features and Refunds
Some features may require payment, processed through a payment gateway (PG). Refunds are governed by our Refund Policy.
Article 10. Suspension and Termination
The Operator may suspend or terminate access without prior notice if a Member violates these Terms or applicable law.
Article 11. Disclaimer
- The Operator is not responsible for damages caused by force majeure, network outages, payment-gateway failures, or other events outside its reasonable control.
- The Operator does not warrant the accuracy or reliability of any Result and is not liable for decisions a Member makes based on Results.
Article 12. Limitation of Liability
To the maximum extent permitted by law, the Operator’s total liability to a Member shall not exceed the greater of (a) the amount the Member paid to the Operator in the 12 months before the claim or (b) USD 100.
Article 13. Governing Law and Jurisdiction
These Terms are governed by the laws of Republic of Korea. Disputes shall be resolved by the courts having jurisdiction under the Civil Procedure Act.
